Terms and Conditions
Bookings
Atlantic Surf Pods only takes bookings from persons over 18 years old. Atlantic Surf Pods reserves the right to refuse a booking at any time – without giving reason. Atlantic Surf Pods will confirm and invoice the booking to you by email. The confirmation, including the invoice, must be checked for correctness following receipt. Possible or alleged inaccuracies must always be made known by telephone or email before the start of the stay. If, due to unforeseen circumstances, Atlantic Surf pods must make a change to a booked reservation regarding the type and/or location of the accommodation, Atlantic Surf Pods will make every effort to offer you a suitable alternative.
Group Bookings
Atlantic Surf Pods reserves the right to refuse group bookings if the purpose and size of the group is not appropriate. Group bookings will be considered on a case by case basis. Whilst we do take multiple bookings in the Surf Pod area, Atlantic Surf Pods does retain the right to change your Pod number if required in order to manage their bookings. At busy times, your pod number may change at short notice.
Price
The prices on www.atlanticsurfpods.co.uk are not binding, Atlantic Surf Pods reserves the right to change these prices. Atlantic Surf Pods reserves the right to refuse bookings when they are made under evidently incorrect sales prices. The customer must then rebook directly so that they can be informed of the correct price.
Accommodation rental
Occupation must be limited to a maximum of two adults and two children (or three adults) per pod, unless arranged prior to arrival. The agreement is personal to the visitor. The visitor must not use the accommodation except for the purpose of a holiday by the visitor and the visitor’s party during the holiday period, and not for any other purpose or longer period.
Loss of Property
Atlantic Surf Pods cannot be held responsible for loss or damage to visitor property, or for injury sustained by the visitor or their party, unless the loss, damage or injury is a direct result of negligence.
Pets
Atlantic Surf Pods cannot accept pets in any area of the Surf Pod accommodation.
Payments
A 30% deposit must be made at the time of booking to secure the reservation. The outstanding balance must be made no less than 30 days prior to the arrival date. Bookings made within 30 days of the start of the stay must be paid in full at the time of booking. Failure to adhere to this may result in the reservation being cancelled.
Alteration costs
In principle, changes within 42 days of arrival are not allowed. Changes requested prior to 42 days before arrival may be implemented where possible and practical, however Atlantic Surf Pods reserve the right to choose whether, and to what extent, these changes will be made. Amendments are charged at an admin fee of £30, plus any increase in charge for higher rates where applicable.
Transfer of rights
Only persons with whom the agreement has been made will have rights under the contract
Cancellations (without policy)
Any cancellations made by the customer for whatever reason must be confirmed in writing via email to bookings@atlanticsurfpods.co.uk. In the case of cancellation within 42 days prior to the start of the stay, the full amount is due and non-refundable. In the event of cancellation more than 42 days prior to the start of the stay, the 30% deposit is due and non-refundable. On receipt of notice of cancellation more than 42 days prior to the start of the stay, Atlantic Surf Pods will seek to re-let the property for the period of booking. If it succeeds in re-letting the property for the whole period it shall refund any monies paid minus the non-refundable deposit and a £30 admin fee. If it succeeds in re-letting part of the stay, it shall refund any monies paid minus the non-refundable deposit, a £30 admin fee and the rental for the period which is not re-let. If Atlantic Surf Pods is unable to re-let the property, the full amount is non refundable. In the event of premature termination of the stay, the full amount is due and non refundable. Atlantic Surf Pods strongly recommends that the customer take out travel insurance from a 3rd party provider to protect from losses in the event of cancellation.
Cancellations (with policy)
We offer an optional cancellation policy for our camping pitches and surf pods. The payment of £10 per holiday week protects you and your party, up to and including the day before you holiday, against loss of all monies already paid (excluding the £10 per week premium) due to redundancy, jury service, personal injury, illness or death to any member of your party. Supporting evidence (such as a Doctor’s certificate, redundancy notice etc) will be required for a refund to be able to be issued. The Cancellation Policy applies only to holidays booked in our own camping pitches and surf pods. It does not apply to holidays in our holiday cottages or lodges. Please note that as of 5th March 2020, this cancellation policy does not cover a pandemic or epidemic. In all circumstances we strongly recommend you take out your own holiday insurance as no refunds will be issued for any reason other than those covered by the cancellation plan. COVID – 19 is now classed as an illness and will therefore be covered by the above plan if you can provide evidence that you, or any member of your party are unable to travel. Holiday insurance companies are now selling holiday insurance policies that cover COVID-19 so we strongly advise that your own holiday insurance is purchased in addition to our policy above to provide an extra level of protection.
Arrival and Departure
Adherence to arrival and departure times forms part of this agreement; any stay that extends over this period will be subject to a charge being made. Arrival time is between 4pm and 6pm on the day of arrival. Departure time is before 10am on the day of departure. In the case of arrival outside of the listed hours please contact us to arrange access. Later arrivals will be possible by arrangement but will be unattended.
Domestic Regulations
The visitor undertakes to keep the accommodation in the same state of repair and condition as at the commencement of the booking period and shall be liable for any damages outside of reasonable wear and tear. The visitor must not use the accommodation for any dangerous, offensive, noisy, illegal or immoral activities. A surety bond may be requested at the time of booking if deemed necessary, at the discretion of Atlantic Surf Pods. The visitor agrees to leave the accommodation in a reasonably clean and tidy state, and will be liable for extra charge to cover the expense of any unusual additional cleaning that is required. Atlantic Surf Pods maintain a strict NO SMOKING policy inside the pods. Atlantic Surf Pods must be allowed to enter the accommodation if necessary and with reasonable notice given; in the case of emergency they reserve the right to immediate access. Atlantic Surf Pods reserves the right to carry out maintenance work required; reasonable compensation will be considered for any foreseeable inconvenience.
Force majeure
If the implementation of the agreement is entirely or partially, temporarily or permanently, prevented due to circumstances which are beyond control of the owner, this may be interpreted as force majeure. In this instance, such as where natural disasters, strikes, government measures, epidemics or outbreaks of hostilities prevent the owner from opening, Atlantic Surf Pods reserves the right to close their business. In the event of force majeure Atlantic Surf Pods will not be obliged to compensate any damages, or to refund the rental cost.
Complaints
Every reasonable care will be taken to ensure that the accommodation is presented to a high standard. Should the customer find that there is a problem or cause for complaint, they must notify one of the staff immediately. This allows Atlantic Surf Pods the opportunity to take any reasonable steps necessary to resolve the issue. Atlantic Surf Pods will not normally make any refunds in respect of complaints made after the visitors departure if the visitor did not make the complaint known to the team during their stay.
Day visitors
Day visitors are considered at the discretion of Atlantic Surf Pods and by prior arrangement only. If you are travelling with visitors also staying at Atlantic Farm who are staying in other areas of the grounds, collectively gathering within the Surf Pod area must be by prior arrangement only and will be considered on a case by case basis.
Right to Evict
Atlantic Surf Pods retains the right to evict the visitor without any compensation being made if the visitor is in serious breach of the agreement. If any complaints of antisocial behaviour or non-adherence to policies occurs, Atlantic Surf Pods will give the visitor an opportunity to rectify the breach; failure to do so shall entitle Atlantic Surf Pods to terminate the agreement.
Governing Law
The Law of England and Wales shall govern the construction, validity and performance of the agreement and both parties submit to the non-exclusive jurisdiction of the UK courts.
